1. Purpose and Scope of the Clarification Text
Hereby Statement was prepared for expressing the approach of our Company regarding the aspects of protection of personal data of our customers, potential customers, employees, employee candidates, company shareholders, company officials, visitors, employees, shareholders, and officials of the organizations we work in cooperation with and the third parties (briefly "person related to the data") within scope of Law on Protection of Personal Data ("KVKK") and to inform the persons related to the data accordingly in line with the importance placed by İstanbul Akvaryum Turizm Ticaret Limited Şirketi (“Company”) on personal data.
Data which are included within the scope of Clarification Text ("Text") on Processing of Personal Data are related to any personal data of the person related to the data, processed through means which are automatic or, provided that it is a part of a data recording system, which are not automatic.
The present Text issued by our Company is dated 08.11.2018. In case of renewal of the entire text or certain articles, effective date and version of the Text will be updated. The Text is published on the website (www.istanbulakvaryum.com/kvkk) of our Company and provided to the access by respective persons upon request of the person related to the data.
2. Principles Regarding Personal Data
a. Processing of Personal Data
Our Company processes your personal data in compliance with article 20 of the Constitution and article 4 of KVKK according to the following principles:
Our Company provides information and fulfills the obligation to provide clarification regarding the following in the course of acquiring such personal data in compliance with article 20 of the Constitution and article 10 of KVKK:
b. Legal Grounds for Processing Personal Data
Our Company processes personal data in compliance with article 5 of KVKK and in accordance with the following legal grounds;
Article 6 of KVKK specifies certain set of personal data which constitutes the risk of causing unjust treatment or discrimination of persons if processed illegally as "sensitive". Such data include race, ethnical background, political opinion, philosophical belief, religion, sect or other beliefs, appearance, society, foundation or union membership, health, sexual life, conviction and data provided regarding security measures, biometric and genetic data. Sensitive personal data are processed by our Company in case of following conditions provided that sufficient measures to be established by Personal Data Protection Board (Board) are taken:
Our Company receives express consent from the data owner for processing data in the case that aforementioned data processing conditions do not exist.
c. Transfer of Personal Data
Our Company may transfer personal data specified in part 2.b of the present Text in line with the purposes specified in the same part for the following purposes;
ç. Purpose of Collecting Personal Data
Your personal data is being collected for providing, improving the products and services we offer and to carry out our commercial activities in line with the aforementioned purposes. Your personal data collected in this process are collected on the legal grounds of executing our commercial operations through our employees and agencies our through public databases within scope of the concerning legislation. Your personal data collected on these legal grounds can be processed and transferred pursuant to the conditions and for the purposes of data processing specified in articles 5 and 6 of the Law 6698 and also for purposes indicated in articles (b) and (c) of the present Clarification text.
Personal data is processed by our Company in line with the following purposes within scope of the aforementioned conditions and with the purpose of delivering services by our Company and pursuant to the national legislation.
Management of internal system and application management operations, legal operations.
Personal data which falls within scope of this text and person related to the data which is processed are categorized and classified by our Company and indicated in KSV1_LİST and KSV2_LİST, respectively.
d. Retention and Deletion of Data
Our Company retains the personal data it processes for the periods specified in the legislation and if no additional period is specified in the legislation; the personal data is retained for the period required for processing such data pursuant to the practices and customs of the business life by our Company depending on the services delivered by our Company while processing such data, and only for periods which are demonstrated to be necessary in practice for constituting evidence in case of possible legal disputes following such period. Following end of the specified periods such personal data is deleted, destroyed or rendered anonymous.
3. Rights of the Data Owner
Article 20 of the Constitution states that everyone is entitled to be informed regarding the personal data related to himself/herself, while article 11 of KVKK states that right of "requesting information" is among the rights of the owner of the personal data. Within this scope, our Company provides required information if requested by the owner of the personal data; and our Company informs the respective data owner regarding the manner of exercising such right of requesting information and the way of evaluating the aspects regarding the information request with the present Statement.

Since the following circumstances are excluded from the scope of KVKK pursuant to article 28 of KVKK; the person related to the personal data may not claim the aforementioned rights in such circumstances:
Pursuant to article 28/2 of KVKK, in case of the following conditions; the person related to the personal data may not claim the aforementioned rights in such circumstances other than claiming indemnification of the damage:
Person related to the personal data may submit his/her claims regarding the aforementioned rights to our Company by fully completing found at the address of www.istanbulakvaryum.com/kvkk and undersigning it with wet signature and delivering it to the address of Şenlikköy Mah.Yeşilköy Halkalı Cad. No:93/1 Florya, Bakırköy/İstanbul either by hand or via notary public or return paid registered mail. In the case that a person other than the owner of the personal data would make a claim, such person shall have a special power of attorney issued by the owner of the personal data in the name of the person to make the application.
Requests duly submitted to our Company will be finalized within thirty days at the latest. In the case that finalization of such claims would require additional cost, our Company will charge a fee indicated in the tariff to be determined by the Board from the applicant. Our Company may request information from the concerned person with the purpose of determining whether the applicant is the owner of the personal data and may ask question to the owner of the personal data regarding his/her application in order to clarify the aspects specified in the application. Our Company may reject the application of the application in the following cases by explaining the reason:
If the application is rejected pursuant to article 14 of KVKK or the provided answer is deemed to be insufficient or no answer is provided within due time, the owner of the personal data may file a complaint to the Board within thirty days upon being informed about the answer by our Company and sixty days following the date of application in any case.
4. Security of Personal Data
a. Security Measures
Our company takes measures and controls for ensuring the suitable security level pursuant to article 12 of KVKK in order to prevent processing of personal data it is processing, prevent access to data in an illegal way and to safeguard the data and to perform required inspections within this scope or cause such to be carried out. In this respect, measures and controls taken by our Company are provided below,
b. Inspection
Our Company carries out or causes to be carried out, required inspections within itself in compliance with article 12 of Law on Protection of Personal Data. Results of such inspection are reported to the department related to the subject within scope of the internal operation of the company and required activities are carried out in order to improve the measures that were taken.
Required systems are being established and employees are provided with necessary trainings in order to raise awareness of the current employees of the business units of the Company and to the ones who are recently recruited in such business unit, regarding protection of personal data.
c. Management of data violations
Our Company operates a system which provides notification to the owner of the respective personal data and to the Board in the case that the personal data processed in compliance with article 12 of KVKK is acquired by other parties through illegal ways, within the shortest time. If deemed necessary by the Board, such case can be announced on the website of the Board or through other methods.

2. Sözleşmenin Konusu
İşbu Sözleşme’nin konusu İstanbul Akvaryum’un sahip olduğu internet sitesiwww.istanbulakvaryum.com‘dan üyenin faydalanma şartlarının belirlenmesi oluşturmaktadır.
3. Tarafların Hak ve Yükümlülükleri
3.1.Üye,www.istanbulakvaryum.cominternet sitesine üye olurken verdiği kişisel ve diğer sair bilgilerin kanunlar önünde doğru olduğunu, İstanbul Akvaryumun’un bu bilgilerin gerçeğe aykırılığı nedeniyle uğrayacağı tüm zararları aynen ve derhal tazmin edeceğini beyan ve taahhüt eder.
3.2.Üye, İstanbul Akvaryum tarafından kendisine verilmiş olan şifreyi başka kişi ya da kuruluşlara veremez, üyenin söz konusu şifreyi kullanma hakkı bizzat kendisine aittir. Bu sebeple doğabilecek tüm sorumluluk ile üçüncü kişiler veya yetkili merciler tarafından İstanbul Akvaryum'a karşı ileri sürülebilecek tüm iddia ve taleplere karşı, İstanbul Akvaryum'un söz konusu izinsiz kullanımdan kaynaklanan her türlü tazminat ve sair talep hakkı saklıdır.
3.3.Üyewww.istanbulakvaryum.cominternet sitesini kullanırken yasal mevzuat hükümlerine riayet etmeyi ve bunları ihlal etmemeyi baştan kabul ve taahhüt eder. Aksi takdirde, doğacak tüm hukuki ve cezai yükümlülükler tamamen ve münhasıran üyeyi bağlayacaktır.
3.4.Üye,www.istanbulakvaryum.cominternet sitesini hiçbir şekilde kamu düzenini bozucu, genel ahlaka aykırı, başkalarını rahatsız ve taciz edici şekilde, yasalara aykırı bir amaç için, başkalarının fikri ve telif haklarına tecavüz edecek şekilde kullanamaz. Ayrıca, üye başkalarının hizmetleri kullanmasını önleyici veya zorlaştırıcı faaliyet (spam, virus, truva atı, vb.) ve işlemlerde bulunamaz.
3.5.www.istanbulakvaryum.cominternet sitesinde üyeler tarafından beyan edilen, yazılan, kullanılan fikir ve düşünceler, tamamen üyelerin kendi kişisel görüşleridir ve görüş sahibini bağlar. Bu görüş ve düşüncelerin İstanbul Akvaryum'la hiçbir ilgi ve bağlantısı yoktur. İstanbul Akvaryum'un üyenin beyan edeceği fikir ve görüşler nedeniyle üçüncü kişilerin uğrayabileceği zararlardan ve üçüncü kişilerin beyan edeceği fikir ve görüşler nedeniyle üyenin uğrayabileceği zararlardan dolayı herhangi bir sorumluluğu bulunmamaktadır.
3.6.İstanbul Akvaryum, üye verilerinin yetkisiz kişilerce okunmasından ve üye yazılım ve verilerine gelebilecek zararlardan dolayı sorumlu olmayacaktır. Üye,www.istanbulakvaryum.cominternet sitesinin kullanılmasından dolayı uğrayabileceği herhangi bir zarar yüzünden İstanbul Akvaryum'dan tazminat talep etmemeyi peşinen kabul etmiştir.
3.7.Üye, diğer internet kullanıcılarının yazılımlarına ve verilerine izinsiz olarak ulaşmamayı veya bunları kullanmamayı kabul etmiştir. Aksi takdirde, bundan doğacak hukuki ve cezai sorumluluklar tamamen üyeye aittir.
3.8.İşbu üyelik sözleşmesi içerisinde sayılan maddelerden bir ya da birkaçını ihlal eden üye işbu ihlal nedeniyle cezai ve hukuki olarak şahsen sorumlu olup, İstanbul Akvaryum’u bu ihlallerin hukuki ve cezai sonuçlarından ari tutacaktır. Ayrıca; işbu ihlal nedeniyle, olayın hukuk alanına intikal ettirilmesi halinde, İstanbul Akvaryum'un üyeye karşı üyelik sözleşmesine uyulmamasından dolayı tazminat talebinde bulunma hakkı saklıdır.
3.9.İstanbul Akvaryum'un her zaman tek taraflı olarak gerektiğinde üyenin üyeliğini silme, müşteriye ait dosya, belge ve bilgileri silme hakkı vardır. Üye işbu tasarrufu önceden kabul eder. Bu durumda, İstanbul Akvaryum'un hiçbir sorumluluğu yoktur.
3.10.www.istanbulakvaryum.cominternet sitesi yazılım ve tasarımı İstanbul Akvaryum mülkiyetinde olup, bunlara ilişkin telif hakkı ve/veya diğer fikri mülkiyet hakları ilgili kanunlarca korunmakta olup, bunlarüye tarafından izinsiz kullanılamaz, iktisap edilemez ve değiştirilemez. Bu web sitesinde adı geçen başkaca şirketler ve ürünleri sahiplerinin ticari markalarıdır ve ayrıca fikri mülkiyet hakları kapsamında korunmaktadır.

3.12.İstanbul Akvaryum kullanıcılarına daha iyi hizmet sunmak, ürünlerini ve hizmetlerini iyileştirmek, sitenin kullanımını kolaylaştırmak için kullanımını kullanıcılarının özel tercihlerine ve ilgi alanlarına yönelik çalışmalarda üyelerin kişisel bilgilerini kullanabilir. İstanbul Akvaryum, üyenin www.istanbulakvaryum.cominternet sitesi üzerinde yaptığı hareketlerin kaydını bulundurma hakkını saklı tutar.
3.13.İstanbul Akvaryum’aüye olan kişi, yürürlükte bulunan ve/veya yürürlüğe alınacak uygulamalar kapsamında İstanbul Akvaryum ve Doğan Online (DOL) iştiraki olan tüm şirketler tarafından kendisine ürün ve hizmet tanıtımları, reklamlar, kampanyalar, avantajlar, anketler ve diğer müşteri memnuniyeti uygulamaları sunulmasına izin verdiğini beyan ve kabul eder. Üye, İstanbul Akvaryum’a üye olurken ve/veya başka yollarla geçmişte vermiş olduğu ve/veya gelecekte vereceği kişisel ve alışveriş bilgilerinin ve alışveriş ve/veya tüketici davranış bilgilerinin yukarıdaki amaçlarla toplanmasına, DOL iştiraki olan tüm şirketler ile paylaşılmasına, İstanbul Akvaryum ve DOL iştiraki olan tüm şirketler tarafından kullanılmasına ve arşivlenmesine izin verdiğini beyan ve kabul eder. Üye aksini bildirmediği sürece üyeliği sona erdiğinde de verilerin toplanmasına, DOL iştiraki olan tüm şirketler ile paylaşılmasına, İstanbul Akvaryum ve DOL iştiraki olan tüm şirketler tarafından kullanılmasına ve arşivlenmesine izin verdiğini beyan ve kabul eder. Üye aksini bildirmediği sürece İstanbul Akvaryum ve DOL iştiraki olan tüm şirketlerin kendisi ile internet, telefon, SMS, vb iletişim kanalları kullanarak irtibata geçmesine izin verdiğini beyan ve kabul eder. Üye yukarıda bahsi geçen bilgilerin toplanması, paylaşılması, kullanılması, arşivlenmesi ve kendisine erişilmesi nedeniyle doğrudan ve/veya dolaylı maddi ve/veya manevi menfi ve/veya müspet, velhasıl herhangi bir zarara uğradığı konusunda talepte bulunmayacağını ve İstanbul Akvaryum ve DOL iştiraki olan şirketleri sorumlu tutmayacağını beyan ve kabul eder. Üye veri paylaşım tercihlerini değiştirmek isterse, bu talebini İstanbul Akvaryum’un müşteri hizmetleri çağrı merkezlerine iletebilir.
3.14.İstanbul Akvaryum, üyenin kişisel bilgilerini yasal bir zorunluluk olarak istendiğinde veya (a) yasal gereklere uygun hareket etmek veya İstanbul Akvaryum’a tebliğ edilen yasal işlemlere uymak; (b) İstanbul Akvaryum ve İstanbul Akvaryum web sitesi ailesinin haklarını ve mülkiyetini korumak ve savunmak için gerekli olduğuna iyi niyetle kanaat getirdiği hallerde açıklayabilir.
3.15.İstanbul Akvaryum web sitesinin virus ve benzeri amaçlı yazılımlardan arındırılmış olması için mevcut imkanlar dahilinde tedbir alınmıştır. Bunun yanında nihai güvenliğin sağlanması için kullanıcının, kendi virus koruma sistemini tedarik etmesi ve gerekli korunmayı sağlaması gerekmektedir. Bu bağlamda üye İstanbul Akvaryum web sitesi'ne girmesiyle, kendi yazılım ve işletim sistemlerinde oluşabilecek tüm hata ve bunların doğrudan ya da dolaylı sonuçlarından kendisinin sorumlu olduğunu kabul etmiş sayılır.
3.16.İstanbul Akvaryum, sitenin içeriğini dilediği zaman değiştirme, kullanıcılara sağlanan herhangi bir hizmeti değiştirme ya da sona erdirme veya İstanbul Akvaryum web sitesi'nde kayıtlı kullanıcı bilgi ve verilerini silme hakkını saklı tutar.
3.17.İstanbul Akvaryum, üyelik sözleşmesinin koşullarını hiçbir şekil ve surette ön ihbara ve/veya ihtara gerek kalmaksızın her zaman değiştirebilir, güncelleyebilir veya iptal edebilir. Değiştirilen, güncellenen ya da yürürlükten kaldırılan her hüküm , yayın tarihinde tüm üyeler bakımından hüküm ifade edecektir.
3.18.Taraflar, İstanbul Akvaryum'a ait tüm bilgisayar kayıtlarının tek ve gerçek münhasır delil olarak, HMK madde 119’a uygun şekilde esas alınacağını ve söz konusu kayıtların bir delil sözleşmesi teşkil ettiği hususunu kabul ve beyan eder.
3.19.İstanbul Akvaryum, iş bu üyelik sözleşmesi uyarınca, üyelerinin kendisinde kayıtlı elektronik posta adreslerine bilgilendirme mailleri ve cep telefonlarına bilgilendirme SMS’leri gönderme yetkisine sahip olmakla beraber, üye işbu üyelik sözleşmesini onaylamasıyla beraber bilgilendirme maillerinin elektronik posta adresine ve bilgilendirme SMS’lerinin cep telefonuna gönderilmesini kabul etmiş sayılacaktır.
4. Sözleşmenin Feshi
İşbu sözleşme üyenin üyeliğini iptal etmesi veya İstanbul Akvaryum tarafından üyeliğinin iptal edilmesine kadar yürürlükte kalacaktır. İstanbul Akvaryum üyenin üyelik sözleşmesinin herhangi bir hükmünü ihlal etmesi durumunda üyenin üyeliğini iptal ederek sözleşmeyi tek taraflı olarak feshedebilecektir.
5. İhtilafların Halli
İşbu sözleşmeye ilişkin ihtilaflarda Bakırköy Adliyesi Mahkemeleri ve İcra Daireleri yetkilidir.
6. Yürürlük
Üyenin, üyelik kaydı yapması üyenin üyelik sözleşmesinde yer alan tüm maddeleri okuduğu ve üyelik sözleşmesinde yer alan maddeleri kabul ettiği anlamına gelir. İşbu Sözleşme üyenin üye olması anında akdedilmiş ve karşılıklı olarak yürürlüğe girmiştir.
